QubixTalent Consulting LLC – Data Privacy & Processing Policy
Applies To: All employees, consultants, contractors, and subcontractors of QubixTalent Consulting LLC
1. Policy Statement
QubixTalent Consulting LLC (“QubixTalent” or “Company”) grants access to data and information resources to its employees, consultants, contractors, and subcontractors solely to enable the performance of their job responsibilities and services. All individuals with such access must read, understand, and agree to this Data Privacy & Processing Policy to maintain access to QubixTalent’s information systems, tools, and infrastructure.
2. Definitions
For the purposes of this policy, the terms “personal data”, “data subject”, “data controller”, “data processor”, and “processing” shall have the meaning defined under applicable data protection laws including, without limitation, the European General Data Protection Regulation (GDPR 2016/679), the California Consumer Privacy Act (CCPA), and other local or international laws as applicable.
3. Data Handling & Compliance Requirements
All individuals processing personal data on behalf of QubixTalent agree to the following:
- Purpose Limitation : Personal data must only be processed for purposes explicitly authorized by QubixTalent or its clients, and in accordance with documented instructions.
- Data Protection Standards : You agree to maintain industry-leading security standards, applying technical and organizational measures to protect personal data from accidental or unlawful destruction, unauthorized disclosure, access, or misuse—including during transmission over networks.
- Restricted Access : Only personnel with a legitimate need to access client or internal personal data may do so. You must ensure that such personnel are properly trained, authorized, and bound by confidentiality obligations.
4. Notifications & Incident Response
You shall promptly notify QubixTalent in writing of the following:
- a. Any actual or suspected data breach, including the nature, scope, and corrective actions taken.
- b. Any request from a data subject (e.g., access, correction, deletion) related to personal data processed on behalf of QubixTalent or its clients, and shall not respond unless expressly authorized.
- c. Any legally binding request for access to personal data by law enforcement or regulatory authorities, unless prohibited by law.
5. Data Return & Destruction
Upon completion or termination of your engagement, or when the data is no longer required for its intended purpose, you must securely delete or return all personal data and confirm such destruction/return in writing.
6. Subcontracting and Sub-processing
You shall not subcontract or transfer any data processing activities to third parties without the prior written consent of QubixTalent and without ensuring that such subcontractors are contractually bound by the same data protection obligations. Copies of all sub-processing agreements must be promptly provided to QubixTalent upon request.
7. Audits & Inspections
QubixTalent, or its authorized third-party auditors, may perform periodic audits (with reasonable prior notice) of your data processing practices, systems, and facilities to verify compliance with this policy and applicable data protection laws.
8. Indemnification
You agree to defend, indemnify, and hold harmless QubixTalent, its clients, and affiliates from and against any liabilities, losses, claims, damages, or legal expenses arising out of or related to any data breach or non-compliance with this Data Privacy Policy caused by your acts or omissions.
9. Mobile Information Disclosure
No Disclosure to Third Parties: QubixTalent does not share mobile information with third parties or affiliates for marketing or promotional purposes. All categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties for any purpose.
10. Policy Acknowledgment
By accessing or processing any data provided by or through QubixTalent Consulting LLC or its clients, you acknowledge and agree to comply fully with this Data Privacy & Processing Policy.
